Marion County Democratic Party Resolution 2009-00001
To Support Implementation of the Tennessee Voter Confidence Act
August 1, 2009
The Marion County Democratic Party believes that free and honest elections are the cornerstone of our Democratic form of government.
In 2002 the US Congress and US Senate adopted the Help America Vote Act to set up a national system of verifiable elections and left the implementation of the Act to the states.
In response to the Federal mandate, The Tennessee General Assembly enacted the “Tennessee Voter Confidence Act” that sets specifications and deadlines for each county to comply. The essence of this legislation is to ensure that there shall be a “Voter-verified paper ballot” to give each vote the assurance of verifiability of the vote count of each election. The Act further states that “Each county shall use a precinct based optical scanner voting system on or before the November 2010 general election”. The Act passed the Senate 32-0 and the House 92-3, was signed by the Governor and is State Law.
Newly elected Secretary of State Tre Hargett has refused to implement the Tennessee Voter Confidence Act in violation of Tennessee and Federal Law.
We, the members of the Marion County Democratic Party, hereby RESOLVE to forward our request that our Secretary of State reconsider his action concerning the law and immediately respond in writing to our request and implement the Tennessee Voter Confidence Act.
We further RESOLVE to forward a copy of this resolution to the Chair of the Marion County Republican Party and ask their support in this resolution to ensure free and fair elections in Marion County and in Tennessee.
We also RESOLVE to forward copies of this resolution to Governor Phil Bredesen, House Speaker Kent Williams, Senate Speaker Ron Ramsey, all members of the Marion County Election Commission, all members of the Marion County Commission, and County Mayor Howell Moss
So ADOPTED and RESOLVED this date, August 1, 2009.
